The sales reported herein were made by NexPoint Strategic Opportunities Fund, an investment company registered under the Investment Company Act of 1940. The sales of Jernigan Capital, Inc. ("JCAP") common stock reported herein were matchable under Section 16(b) of the Securities Exchange Act of 1934. The Reporting Person disgorged $25.92 to JCAP, representing the full amount of the profit realized in connection with the short-swing transaction, less transaction costs.
